Justice Department considers pursuing new indictments against James Comey, Letitia James: report

By Eric December 2, 2025

In a significant development within the ongoing legal battles involving former FBI Director James Comey and New York Attorney General Letitia James, a federal judge has dismissed indictments against both figures. U.S. District Judge Cameron McGowan Currie ruled that the appointment of Lindsey Halligan as interim U.S. attorney was unconstitutional, which invalidated the indictments presented against Comey and James. The judge’s decision, which dismissed the indictments “without prejudice,” suggests that the cases could be refiled if new legal grounds are established. This ruling has sparked a potential pivot in strategy for the Department of Justice (DOJ), which is reportedly contemplating new indictments against the two prominent figures rather than pursuing an appeal of the dismissals.

The implications of the judge’s ruling are profound, especially as it relates to ongoing tensions between the DOJ and the Trump administration. White House press secretary Karoline Leavitt criticized the judge’s decision, suggesting it was an attempt to protect Comey and James from accountability for their alleged misconduct. She asserted that Halligan was legally appointed and qualified for her role, indicating the administration’s determination to challenge the dismissal. U.S. Attorney General Pam Bondi echoed these sentiments at a recent press conference, vowing to explore all available legal options to hold Comey and James accountable. This situation is emblematic of the broader political and legal conflicts that have defined the Trump administration’s relationship with figures in the FBI and state legal systems, highlighting the complexities of accountability and the legal process in high-profile cases.

As the DOJ weighs its options, the potential for new indictments looms large, signaling that this saga is far from over. The cases against Comey and James, both central figures in the political landscape, will likely continue to draw scrutiny and debate as they unfold. The outcome could set important precedents regarding the limits of legal authority and the accountability of public officials, making it a pivotal moment in American legal and political history.
