Judge sides with Meta in antitrust trial, will not spin off WhatsApp and Instagram

By Eric November 21, 2025

In a significant ruling for the tech industry, a federal judge has dismissed the Federal Trade Commission’s (FTC) antitrust lawsuit against Meta Platforms Inc., the parent company of Facebook and Instagram. The lawsuit claimed that Meta had engaged in anti-competitive practices by acquiring rival companies, specifically targeting its purchases of Instagram in 2012 and WhatsApp in 2014. The FTC argued that these acquisitions were part of a broader strategy to stifle competition and consolidate Meta’s dominance in the social media landscape. However, the judge concluded that the FTC had failed to provide sufficient evidence that these acquisitions had harmed competition or consumers, marking a pivotal moment in the ongoing debate over antitrust regulation in the technology sector.

This ruling comes at a time when antitrust scrutiny of major tech firms is intensifying, with regulators worldwide examining the market power of companies like Meta, Google, and Amazon. The judge’s decision is particularly notable given the FTC’s aggressive stance on antitrust enforcement under Chair Lina Khan, who has sought to challenge the prevailing legal standards that have historically favored large corporations. In her efforts, Khan has aimed to reshape the legal framework governing antitrust cases, arguing that traditional measures of competition do not adequately address the complexities of digital markets. Despite the setback in this case, the FTC has indicated its commitment to pursuing other avenues to regulate Meta and similar companies, suggesting that the battle over market competition in the tech industry is far from over.

The implications of this ruling extend beyond Meta, as it sets a precedent for how future antitrust cases may be approached in the rapidly evolving digital marketplace. Critics of the decision argue that it could embolden tech giants to pursue further acquisitions without fear of regulatory repercussions, potentially stifling innovation and reducing consumer choice in the long run. Proponents of the ruling, on the other hand, argue that it reflects a necessary recognition of the complexities of the tech industry and the importance of fostering a competitive environment that allows companies to innovate and grow. As the landscape of digital commerce continues to evolve, this ruling will likely influence the strategies of both regulators and tech companies in navigating the intricate balance between competition and market dominance.
